The complaint centers on Smith’s unconstitutional acquisition of phone records associated with Hagerty and other members of Congress as part of the Arctic Frost investigation. Hagerty alleges that Smith withheld critical information from a federal court in violation of the ethics rules applicable to Tennessee lawyers, which includes Smith. Because Smith withheld that information, the court issued a nondisclosure order preventing Hagerty and his colleagues from challenging Smith’s unconstitutional collection of their records.
