Warnock, Colleagues Launch Bicameral Inquiry Into Trump Administration’s Handling of Tariff Refunds
Senator Reverend Raphael Warnock led a bicameral coalition in pressing the Government Accountability Office to investigate the Trump administration’s failure to deliver timely and accurate tariff refunds Senator Warnock is demanding answers about whether court-mandated refunds are being issued accurately and whether American consumers are ultimately benefiting from them Earlier this year, the Supreme Court ruled that sweeping tariffs imposed by the Trump administration under emergency powers were illegal Senator Reverend Warnock: “The American people deserve a timely, accurate, and transparent refund process that lays bare the total economic devastation of the administration’s erroneous tariff agenda on hardworking consumers” Washington, D.C. — U.S. Senator Reverend Raphael Warnock (D-GA), Ranking Member of the Senate Finance Subcommittee on International Trade, Customs, and Global Competitiveness, Representative Jill Tokuda (D-HI), and Representative Brad Sherman (D-CA) launched a bicameral inquiry calling on the Government Accountability Office (GAO) to investigate the Trump administration’s handling of tariff refunds after the Supreme Court ruled that sweeping tariffs imposed under the President’s emergency powers were illegal. “Georgians are already paying the price for the Trump administration’s reckless and illegal tariff policies. Now, the administration’s failure to deliver court-ordered refunds is putting additional financial strain on hardworking families and small businesses across the country,” said Senator Warnock. “The American people deserve a timely, accurate, and transparent refund process that lays bare the total economic devastation of the administration’s erroneous tariff agenda on hardworking consumers. That’s why I’m joining Congresswoman Tokuda in calling for a comprehensive investigation into how the U.S. Customs and Border Protection is handling these refunds.” “Trump’s reckless tariffs are illegal, incompetent, and hitting working families where it hurts most: their wallets,” said Representative Tokuda . “In Hawaiʻi, where the cost of living is already too high, these tariffs are driving up prices on everyday goods for families and inputs for local farmers. Big corporations are positioned to get billions in refunds while working people are left footing the bill. We’re demanding a full audit to ensure this refund actually makes it back to the people who paid the price.” “Trump’s reckless tariffs have been an unjust tax on American families, driving up the cost of everyday life,” said Representative Sherman. “Nowhere is the damage clearer than in housing. For Los Angeles families rebuilding after the wildfires, and for families across the country, tariffs have made homes harder to build. Families paid these illegal tariffs through higher prices, and they deserve to know whether the refunds will reach them. I’m proud to join Congresswoman Tokuda and Senator Warnock in calling for a full GAO audit.” In the letter, the lawmakers raise concerns about the accuracy of the tariff refund process and question whether consumers, who bore the financial burden of higher prices as a result of the tariffs, will ultimately benefit from the refunds. Following the Supreme Court’s decision invalidating tariffs imposed under the International Emergency Economic Powers Act (IEEPA) and a subsequent lower-court ruling ordering repayments, roughly $100 billion of the $166 billion collected from importers had been refunded as of August 2026. Senator Warnock continues to push back against the Trump administration’s reckless and illegal tariff agenda. Earlier this year, he introduced the Reclaim Trade Powers Act in an effort to end President Trump’s indiscriminate tariff policies, which have created uncertain market conditions for Georgia small businesses and have imposed higher prices on Georgia families. A copy of the letter can be found HERE and text is below: “Dear Comptroller General Brown: “On February 20, 2026, the Supreme Court issued its decision in Learning Resources, Inc. v. Trump, holding that the International Emergency Economic Powers Act (IEEPA) does not grant the president the power to establish tariffs. A subsequent ruling by the U.S. Court of International Trade requires the illegally collected tariffs to be refunded, and as of August 2026, about $100 billion collected under the unlawful IEEPA tariffs had been refunded, out of a total of $166 billion in tariffs charged to 330,000 importers on 53 million items. “This is without question the largest tariff refund operation in U.S. history, and U.S. Customs and Border Protection (CBP) had to create new systems and processes to handle this enormous task. We are concerned about the ability of the administration to completely and accurately refund all IEEPA tariffs. Additionally, we are concerned to what extent consumers, upon whom the financial burden of the tariffs fell, were able to receive any benefits from the refunds. For these reasons, we respectfully request that the Government Accountability Office initiate an audit and evaluation of CBP to review the following issues: What actions has CBP taken to update its system to identify and calculate IEEPA refunds and related interest payments? To what extent has CBP established controls to ensure IEEPA refunds are complete, accurate, properly authorized, and protected against improper or duplicate payments? How many importers received IEEPA refunds? What sectors or industries do they represent? How much did they receive, and in which industries and product categories were refunds concentrated? After receiving tariff refunds, how had importers transmitted the financial benefit downstream to wholesalers, retailers, or final consumers? What challenges did they encounter? To what extent did the IEEPA refunds affect product availability, employment, investment, or firms’ decisions to absorb future cost increases? “We hope GAO’s review will help illuminate how consumers have suffered from higher prices across a range of goods over the last year due to these unlawful IEEPA tariffs. “Thank you for your consideration of our request. “Sincerely,” ###
