Resources / Economy & Jobs Share on Congressman Max Miller Introduces Bipartisan Digital PARITY Act May 19, 2026 Economy & Jobs Government Press WASHINGTON, D.C. – U.S. Congressman Max Miller (OH-07) and Congressman Steven Horsford (NV-04) released bipartisan legislation to modernize the federal tax code for digital assets, providing long-overdue clarity and parity for consumers, investors, and businesses while strengthening tax compliance and protecting the integrity of U.S. markets. “As America continues to lead the world in innovation, our tax code has failed to keep pace with the rapid growth of digital assets and modern financial technology,” said Congressman Miller. “The PARITY Act brings greater clarity, fairness, and common sense to the taxation of digital assets by modernizing outdated policies and creating a more workable framework for consumers, investors, and innovators alike. By establishing a more balanced and predictable tax framework, this legislation is a first step in fostering innovation here at home while ensuring the United States remains competitive in the global digital economy.” “As digital assets continue to grow and evolve, Washington cannot afford to stay stuck in the past,” said Rep. Horsford. “Right now, the lack of clear rules creates uncertainty for consumers, investors, businesses, and regulators while leaving the system game-able for wealthy and sophisticated players. The PARITY Act establishes clear, durable, and administrable standards that strengthen investor protections, provide certainty to markets, and put strong guardrails in place to prevent abuse and manipulation. Innovation should not come at the expense of accountability or fairness. With clear rules of the road, everyday people not just large corporations and the ultra-wealthy can safely participate in these emerging technologies, build wealth, and help close the wealth gap.” Among its key provisions, the bill: Establishes a commonsense tax treatment for regulated payment stablecoins and ensures everyday payment transactions do not trigger unnecessary tax reporting. Clarifies source-of-income rules for digital asset trading, providing certainty for U.S. and foreign market participants while maintaining strong tax enforcement standards. Extends existing securities-lending tax rules to digital assets, ensuring that bona fide digital asset lending is not treated as a taxable sale. Applies wash-sale and constructive-sale rules to digital assets, closing loopholes that allow taxpayers to artificially harvest losses or defer gains. Allows mark-to-market elections for digital asset traders and dealers, aligning tax treatment with established financial market practices. Creates an elective framework for staking and mining rewards, treating rewards as income while allowing deferral of taxation to address liquidity and phantom income concerns. Modernizes charitable contribution rules, distinguishing between highly liquid digital assets and speculative or illiquid tokens to prevent abuse while supporting legitimate charitable giving. Directs Treasury to study a viable de minimis threshold for native tokens while establishing interim guidance to provide immediate tax administrative relief where possible. Bill text here .
