Tuberville Urges SCOTUS to Protect Women and Babies from Dangerous Abortion Drugs

WASHINGTON – U.S. Senator Tommy Tuberville (R-AL) joined more than 100 Republican lawmakers in both the Senate and House of Representatives in filing an amicus brief with the U.S. Supreme Court supporting a lawsuit to protect women and their unborn children from dangerous mail-order chemical abortion drugs. The brief argues that mifepristone’s in-person dispensing requirement must be reinstated. Earlier this year, Sen. Tuberville helped introduce the Safeguarding Women from Chemical Abortion Act, which would withdraw Food and Drug Administration approval of mifepristone for abortion and empower women harmed by taking the drug to sue its manufacturers. “Mifepristone is extremely dangerous and has no place in this country,” said Sen. Tuberville. “The mainstream media won’t tell you this, but one in ten women who take this dangerous drug suffers serious health problems. The safety of America’s mothers and children should not be a political pawn. I urge the justices of the Supreme Court to affirm Louisiana’s decision and protect women and babies across the country.” Sen. Tuberville was joined by Sens. Tuberville has long been a staunch pro-life advocate, raising awareness about illegal and immoral taxpayer-funded abortions being administered at the Biden-era Department of Veterans Affairs and the Biden-era Department of War. Sen. Tuberville’s efforts led to the reversal of both policies under the Trump administration. In October 2025, Louisiana and Rosalie Markezich, a victim of Democrats’ harmful decision to remove the in-person dispensing requirement for dangerous chemical abortion drugs, filed a lawsuit to overturn the illegal policy. Because of Biden’s policy, Rosalie’s boyfriend was able to order chemical abortion pills online from an abortionist in California and coerced her to take the drug to kill her unborn child. The Republican lawmakers argue that Biden violated federal law by removing the in-person dispensing requirement, and that these protections should be reinstated. Recently, the Fifth Circuit Court of Appeals sided with Louisiana, issuing an order that put the in-person dispensing requirement back into place while the litigation continues. The amicus brief asks the Supreme Court to uphold the Fifth Circuit’s decision.
