53 Members of Congress Demand HHS and Cms Halt Medicaid Data Sharing with ICE

FOR IMMEDIATE RELEASE: September 9, 2026 MEDIA CONTACT: e: jessica.myers@mail.house.gov c: 202.913.0126 WASHINGTON, DC – U.S. Representatives Yvette D. Clarke (NY-09), Robin Kelly (IL-02), Nanette Barragán (CA-44), and Emily Randall (WA-06) led 49 Members of Congress in sending a letter to Department of Health and Human Services (HHS) Secretary Robert F. Kennedy, Jr. and Centers for Medicare & Medicaid Services (CMS) Administrator Dr. Mehmet Oz calling for an immediate end to the sharing of Medicaid enrollee data with Immigration and Customs Enforcement (ICE). Despite a federal preliminary injunction limiting data transfers, CMS continues to share private data belonging to millions of enrollees—including U.S. citizens and lawful residents—beyond court-approved limits. Reports also reveal ICE improperly mishandled the data across internal channels and shared it with third-party analytics contractors like Palantir Technologies. “The role of HHS should be to protect the health of all those living in this country and provide essential human services, not to be a watchdog for DHS or act as immigration enforcement,” the Members stated in the letter.
