Cornyn Introduces No Tax on Border Patrol Agent Overtime Act News Cornyn Introduces No Tax on Border Patrol Agent Overtime Act May 21, 2026 HOUSTON – U.S. Senator John Cornyn (R-TX) introduced the No Tax on Border Patrol Agent Overtime Act , which would allow Border Patrol agents to claim the No Tax on Overtime deduction Republicans secured in the Working Families Tax Cuts Act to keep more of their hard-earned dollars: “Border Patrol agents put their lives on the line each and every day to protect our communities and uphold federal immigration law, oftentimes working long hours in harsh conditions,” said Sen. Cornyn. “My bill will ensure agents aren’t taxed for overtime they put in to ensure Americans are safe and our borders are secure, and I urge my colleagues to join Congressman Arrington and me in supporting the No Tax on Border Patrol Agent Overtime Act so agents can keep more of their hard-earned money.” “We thank Senator Cornyn and Congressman Arrington for introducing the No Tax on Border Patrol Overtime Act in the Senate and House,” said National Border Patrol Council (NBPC) President Paul Perez. “Right now, millions of American taxpayers can deduct up to $12,500 in overtime earnings if single and up to $25,000 if married and filing jointly. As you can imagine, this provision is enormously helpful for working families, though it does not cover Border Patrol Agents. Senator Cornyn’s and Congressman Arrington’s legislation extends this benefit to almost 20,000 Border Patrol Agents who protect this country. Background: In 2025, Republicans fulfilled President Trump’s promise to deliver no tax on overtime in the Working Families Tax Cuts Act . The bill included a provision providing a $12,500 deduction for overtime pay and $25,000 for joint filers. The No Tax on Overtime deduction applies to all workers subject to the Fair Labor Standards Act . However, Border Patrol agents are subject to different overtime rules prescribed by the Border Patrol Agent Pay Reform Act of 2014 , and thus, cannot currently claim the deduction. The No Tax on Border Patrol Agent Overtime Act would add Border Patrol agents whose pay rates are prescribed by the Border Patrol Agent Pay Reform Act of 2014 as eligible to claim the No Tax on Overtime deduction. This will ensure that Border Patrol agents, many of whom work mandatory scheduled overtime to protect our borders, are able to deduct their overtime pay from their income taxes, just like the millions of other Americans who are already claiming this benefit. This legislation is endorsed by the NBPC.
