Kevin Mullin (CA-15) to protect consumers from nitrous oxide abuse continued today as his bill cleared a critical legislative step, just two weeks after parent advocates traveled to Capitol Hill to call for action against this dangerous product. Rep. Mullin’s Nitrous Oxide Safety Act passed the full House Energy & Commerce Committee today by unanimous vote, advancing legislation that would prohibit the sale of nitrous oxide directly to consumers while preserving legitimate medical, industrial, food production, and research applications. The bill had already received unanimous approval during a markup of the Subcommittee on Commerce, Manufacturing, and Trade on September 1. With the approval by the full committee, the bill now heads to the House Floor for a vote by the entire chamber. The committee vote comes just two weeks after more than 40 parents and family members with People Against Nitrous Oxide (PANOS), representing families from at least 15 states who had lost or had family members injured by nitrous oxide abuse, joined Rep. Mullin at the U.S. Capitol on September 2 for a press conference and day of advocacy. The families shared their stories and urged lawmakers to take action to prevent other families from experiencing the devastating consequences of nitrous oxide abuse. “Today’s vote is a testament to the hard work and determination that the families and advocates have poured into this fight, and I’m proud to see that work paying off as the Nitrous Oxide Safety Act moves one step closer to the House floor,” said Rep. Kevin Mullin. “I have seen firsthand how parents who have experienced unimaginable loss have turned their grief into action, traveling to Washington and raising their voices to make sure no other family has to suffer the same pain. Their determination is what has kept this effort moving forward, and I’ll continue pushing until this bill becomes law so that no other parents have to lose their children to this deadly product.” Rep. Mullin’s Nitrous Oxide Safety Act prohibits all consumer sales of nitrous oxide in both physical retail stores and online, while preserving legitimate medical, industrial, and food production applications. The Consumer Product Safety Commission would enforce the federal law, and anyone selling nitrous oxide could potentially face civil or criminal penalties if their products get into the hands of consumers for household or recreational use. Specifically, the Nitrous Oxide Safety Act would: Prohibit the sale of nitrous oxide products to consumers for household use; Strengthen regulatory clarity to prevent retail and online mislabeling or youth-targeted marketing of nitrous oxide canisters. Preserve access for licensed medical and dental professionals using nitrous oxide under established clinical protocols; legitimate industrial, food production, automotive, and research applications; and Allow continued sale of legitimate multi-ingredient food products that contain nitrous oxide as a component (such as whipped cream canisters used in commercial and household cooking). The Nitrous Oxide Safety Act is a straightforward approach that reflects growing bipartisan concern over the rapid rise in inhalant misuse, and the need to modernize consumer protections.
