Rep. Roy Demands Answers from FDA on Delayed Review of Biden’s Mail-Order Abortion Pill Policy

October 14, 2026 Press Release Washington, D.C. – Today, Congressman Chip Roy (TX-21) sent a letter to Food and Drug Administration (FDA) Acting Commissioner Kyle Diamantas demanding answers after the agency indicated that its safety review of mifepristone would not be completed until March 2027, despite assurances that the Biden Administration’s January 2023 modifications to the drug’s dispensing requirements would be addressed by fall 2026. Those modifications eliminated the in-person dispensing requirement and expanded distribution through the mail. Rep. Roy wrote: “House Republicans cannot be expected to continue funding the implementation of the January 2023 REMS modifications indefinitely while FDA repeatedly extends its review without committing to corrective action.” The letter comes after Rep. Roy earlier this year agreed to withdraw his amendment that would have prohibited federal funds from being used to implement the Biden Administration’s changes to the mifepristone REMS framework, based on a good-faith understanding that the FDA would complete and publish the mifepristone safety study this fall. As Roy states in the letter: “I did not withdraw my amendment so that FDA could conduct an open-ended review while continuing to administer the Biden Administration’s policy.” He further warned: “If FDA will not act to reverse the Jan 2023 REMS modifications, including reinstating the in-person dispensing requirement, Congress must act. Absent prompt action, I will seek to include my amendment in the next continuing resolution to prohibit taxpayer dollars from being used to implement, administer, or enforce the Jan 2023 REMS modifications.” You can read the full letter here.
