Rep. Boebert, 2a Caucus Co-Chair, Celebrates Justice Department Decision to Dismantle National Firearms Act, Delivering for Gun Owners

October 10, 2026 Press Release LONE TREE, CO. — Rep. Lauren Boebert, Co-Chair of the Second Amendment Caucus, celebrated the Department of Justice and Bureau of Alcohol, Tobacco, Firearms and Explosives guidance that dismantles deep state burdens on gun owners under the National Firearms Act for short-barreled rifles, short-barreled shotguns, suppressors, and “any other weapons,” delivering for gun owners. “This is a long-overdue win for law-abiding Americans and a direct result of both the courts and Congress doing the right thing,” said Rep. Boebert . “I was proud to vote for the One Big Beautiful Bill, which included the provision that eliminated the NFA tax on short-barreled rifles, short-barreled shotguns, suppressors, and certain other firearms. Once the tax was gone, the registration scheme lost its constitutional foundation. The Justice Department decision finally puts that reality into practice for gun owners across the country. The guidance follows an August ruling by the U.S. District Court for the Northern District of Texas in Silencer Shop Foundation v. ATF.  The court held that key NFA registration, approval, and related requirements could no longer be enforced for those categories after Congress eliminated the making and transfer taxes. The Department of Justice declined to appeal, and ATF has now stated it will not enforce the prior approval, registration, tax-stamp, and related NFA requirements for these items nationwide, effective October 9, 2026. “Congratulations to Gun Owners of America and the other plaintiffs for fighting this case and securing the injunction that made this possible. The Second Amendment is not a suggestion, and this guidance is a meaningful step toward treating it that way.” Rep.
