Rep. Neguse Issues Statement Following Oral Arguments Before D.C. Circuit Court of Appeals in Neguse v. ICE

November 3, 2026 Press Release Washington, D.C. — Colorado Congressman Joe Neguse issued the following statement upon conclusion of oral arguments in Neguse et al. v. ICE et al. before the U.S. Court of Appeals for the District of Columbia Circuit: “Members of Congress will not be intimidated or deterred from ensuring DHS, ICE, and the federal government are held accountable to the rule of law. Real time oversight is a fundamental responsibility for those of us elected to serve the American people and we will continue to exercise it as a vital tool for delivering transparency to the public. Continued attempts by the Trump administration to ignore or impede our lawful authority in this matter cannot go unchallenged.” Rep. Neguse led 13 Members of Congress in suing the Trump administration after it unlawfully denied them entry to federal immigration detention facilities. Earlier this year, the plaintiffs secured a victory when a federal court ordered the U.S. Department of Homeland Security (DHS) and Immigration and Customs Enforcement (ICE) to restore the Members’ oversight authority. However, ICE has since appealed the District Court’s ruling, seeking once again to limit the right of Members of Congress to investigate detention conditions, ensure compliance with the law, and respond to growing reports of abuse and violence inside detention centers. Neguse and his fellow Members of Congress are represented in the matter by Democracy Forward Foundation and American Oversight. ###
